The Law Firm is traditionally active in both the maritime and land transport sectors.

Conte & Giacomini gave consultancy and judicial assistance in the maritime field, with particular regard to: ship and cargo insurance, ship-leasing, charter, general and particular average, P&I coverage, navigation accident, maritime public permission, maritime fishing, compensation for passengers and cargo’s damages, maritime work, enforcement on ships. The Firm also deals with ships seizures worldwide.

The Law Firm regularly offers advice and assistance to numerous important Italian and European road haulage companies and is a consultant to one of the most important business associations operating in Italy. The Conte & Giacomini Law firm guarantees rapid assistance to road haulage companies for any events related to vehicles (judicial confiscation, accidents, theft, etc.) or to drivers (arrests, accidents with casualties, civil or criminal responsibility), through the consolidated network of associated co-operators in Europe.

In the road freight haulage sector, the Firm is particularly known for its efficiency in dealing with problems related to the so-called “tariffe a forcella” (price-bracket tariffs) for road haulage, which has been engaging some of the firms associates in important disputes before the Luxemburg Court of Justice.

Likewise, it is worthy to mention our special competence relevant to matters regarding Community subsidies for freight companies, to matters concerning insurance of damages to both vehicles and goods and to providing advice in closing contracts for the coverage of risks with insurance companies.

Ports Law

In the ports sector Conte & Giacomini played a leading role in the jurisprudential and regulatory evolution that led to the reform of port legislation (law 84/94 and following amendments).

Since the famous Merci Convenzionali / Porto di Genova judgment was issued (lawsuit C-179/90) by the European Communities Court of Justice, sponsored by the lawyers Giuseppe Conte and Giuseppe Giacomini, the Firm has been co-operating at all levels for the affirmation and implementation of principles dictated by European Community Law in national laws and regulations that govern the sensitive sector of port activities.

Thanks to the great experience gained, Conte & Giacomini offers assistance and advice to leading Italian terminal operators in the important sector of concessions and authorization and generally on all issues pertaining to port activities as well as sea and land intermodality.

The specific interdisciplinary capacity of the staff permits a full range of consultation; ranging from customs problems to those linked with terminal operation management, connected with responsibilities for safety at work and accident prevention.
